1. About us

2. Scope

These Terms govern all orders placed through the Store by consumers and businesses in Poland, Germany, Spain and other countries we ship to. By placing an order you accept these Terms. Statutory consumer rights under EU and national law remain unaffected - nothing in these Terms limits rights that cannot be limited by contract.

3. Products and prices

Product presentations in the Store are an invitation to place an order, not a binding offer. All prices include applicable VAT. Shipping costs are shown separately at checkout before you place your order. We reserve the right to correct obvious pricing errors; if a price error affects your order, we will contact you before dispatch and you may cancel free of charge.

4. Ordering and contract conclusion

Placing an order constitutes an offer to purchase. The contract is concluded when we send you an order confirmation email. The contract language is English. We store the contract text and send you the order data by email.

5. Payment

Available payment methods are shown at checkout. Payment is due at the time of ordering. We do not store your full payment card details; payments are processed by our payment service providers.

6. Delivery

We ship to Poland, Germany and Spain. Delivery times and costs are described in our Shipping Policy. If a product becomes unavailable after your order, we will inform you immediately and refund any payments without delay.

7. Right of withdrawal (consumers)

Consumers in the EU have the right to withdraw from the purchase within 14 days of receiving the goods, without giving any reason. Details, the model withdrawal form and the consequences of withdrawal are set out in our Refund Policy.

8. Warranty and conformity

We are liable for lack of conformity of goods in accordance with EU Directive (EU) 2019/771 and applicable national law (in Poland: ustawa o prawach konsumenta; in Germany: BGB; in Spain: Real Decreto Legislativo 1/2007). For consumers this means a statutory conformity guarantee of at least two years from delivery. If a product is defective, contact us at contact@shesthenics.com - you may request repair or replacement, and where applicable a price reduction or refund.

9. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, contract-typical damage. Our products are sports equipment - use them responsibly, on stable surfaces, and inspect them before each use.

10. Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise. 11. Governing law

These Terms are governed by Polish law. If you are a consumer, you additionally enjoy the protection of the mandatory consumer-protection provisions of the country of your habitual residence (e.g., Germany or Spain).
